Who sells to you

The developer that gave you the code is not a party to this purchase: the contract is between you and X-Datik.

What you buy

Images of your future home with the finishes you chose, made to order for you from the developer's plans. Depending on the level, also a video walk-through and a 360° tour you can explore by dragging. What each level includes is what the screen where you choose it describes.

With the delivery you also get the choices sheet: the finishes you picked, with the names from the developer's catalogue and the price of the extras.

Price and payment

Prices are in euros and include VAT. You pay the total shown on screen before paying, with your developer's code discount already applied.

Payment is handled by Stripe. X-Datik never sees or stores your card details. You receive the invoice by email.

The developer that gave you the code receives a commission from X-Datik for your purchase. It does not change what you pay.

Delivery

When you pay we email you your personal link. That is where you see what you chose and where the delivery arrives, within 7 days of payment. We let you know by email and, if you gave us your mobile number, by WhatsApp.

Anyone with the link can see your home: share it only with the people you want.

The images are indicative

The images show the finishes you chose on the developer's plans. The built home may differ in details: the light, the exact tone of the real materials, changes during construction. Furniture and decoration are only examples.

What counts for the building work is the developer's floor plan and building specification. Claims about the built home go to the developer; claims about the images go to X-Datik.

Changes and mistakes

If you are not happy with the delivery, you get one round of changes free: ask for it with the button on your personal link or on WhatsApp.

If the mistake is ours (a finish that is not the one you chose, the wrong flat), we redo it at no cost, on top of that round. If it is still not what you ordered, the next section applies.

Refunds

If you ask for a refund before we start preparing your home, we give you back everything you paid. Your bank takes 5 to 10 days to show it.

If you don't like it: one round of changes free, as the previous section says.

If what we deliver is not what you ordered (it does not match the sample flat, your floor plan or what you chose), we redo it; if we cannot, we refund the amount or the part that applies. This does not limit the legal guarantee of conformity (articles 114 and following of the consolidated text of the Spanish General Law for the Defence of Consumers and Users).

Right of withdrawal

Spanish law gives you 14 days to withdraw from many distance purchases. It does not apply to digital content not supplied on a tangible medium once its preparation has started with the buyer's express consent and acknowledgement that the right is thereby lost (Royal Legislative Decree 1/2007, consolidated text of the General Law for the Defence of Consumers and Users, article 103(m)). What you buy is digital content: images, video or PDF documents, depending on the level, that reach you through a link.

Before paying you tick two boxes. With the first, «I accept the terms of purchase. We handle your data according to the privacy policy.», you accept these terms. With the second, «I ask you to start on my flat now and I understand that, once you start, I lose the right of withdrawal.», you ask us to start within those 14 days and acknowledge that, once we start, you lose the right of withdrawal. The email we send you when you pay confirms it (article 98.7 of the same law). Until we start, you can withdraw and we refund everything, as the previous section says.

Using what you receive

The images, the video and the visit are for you: you can view, save and share them with anyone you like. You may not resell them or use them to advertise the home or the development without permission from X-Datik and the developer.

If you have no code

If you come without a developer's code, you buy one of the levels on the levels screen (Room, Flat or Complete), with what that screen describes, based on the floor plan of your flat that you upload. The studio models your flat from that floor plan and from the photos, if you add them. Where this section says something different from the ones above, which talk about a developer's plans and catalogue, this section applies.

Prices are in euros and are the final price, the same in every country. We sell to any country. With a billing address in Spain or another country of the European Union, the price includes Spanish VAT. Outside the European Union you pay the same price; Spanish VAT is not charged when it does not apply, and if your country charges import taxes or VAT on this service, they are your responsibility.

Delivery time is counted in business days, and before you pay we show you the date you will have it. If the queue is long, it can take longer; we also tell you so before you pay, with the number of days.

Launch coupon: the first flats are half price in exchange for you posting your flat's video. We ask you to, but we do not check. When you post it, say that it is a collaboration with X-Datik (for example, #ad or "discount from @xdatik"). The coupon cannot be combined with a partner's code (an interior designer, an architect or a brand): the bigger discount applies. Once the places run out, you pay the normal price.

The furniture in your flat is sample furniture: example pieces with their measurements, not products from a shop. We do not deliver a shopping list or furniture prices. If one day there is furniture from shops with prices, you will see it on the levels screen before paying.

Upgrade: once we have delivered your flat, from your personal link you can move it to a higher level (from Room to Flat or Complete, from Flat to Complete) paying only the difference between today's list prices of the two levels, VAT included as in the rest of this section (with the billing country of the original order), with no coupon and no partner code, even if the original order had one. The upgrade is a new order, with its own invoice and its own delivery date, which we show you before you pay; the new work arrives at the same link. Its refunds and changes follow the same rules as an order.

Gifts

You can give one of the levels on the levels screen (Room, Flat or Complete) to someone else. You pay the level's list price, with Spanish VAT included whatever your country, with no coupon and no partner code. The invoice is in your name, because you are the one paying.

You choose when we send it and the language: today, and then it goes out as soon as the payment is confirmed, at any hour; or a day within the next 180 days, and then it goes out that day from 8 am (Madrid time). The recipient gets an email with your message, if you wrote one, and a code. The code is valid for 12 months from the day of payment and can be used only once, for the level given, without changing it for another.

The recipient uploads the floor plan of their flat and follows the same journey as any buyer without a code; at the end they redeem the code instead of paying. If they want more, once they receive their flat they can upgrade it paying the difference, as the previous section explains.

Whoever paid for the gift waives nothing: we do not start until it is redeemed, and they can ask for a full refund as long as it has not been redeemed, even if it has expired. Once redeemed, the order's refund policy applies (in full if asked before we start preparing the flat) and the money goes back to whoever paid for the gift.

Law and courts

These terms are governed by Spanish law. If there is a disagreement we cannot settle by talking, you can go to the courts where you live.

We keep with your order the version of these terms you accepted.
